WGH is not responsible for content posted by others and is not obligated to respond to social media posts. Do not post personal medical information on public social platforms.

The Online Services and their content (text, graphics, logos, images, audio/video, software, and design) are owned by WGH or its licensors and protected by applicable laws.

Limitation of Liability

30. Limits on Damages

To the fullest extent permitted by law, WGH (and its affiliates, licensors, suppliers, and service providers) will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of (or inability to use) the Online Services.

To the extent direct damages cannot be excluded, WGH’s total liability for claims arising out of or relating to the Online Services will not exceed the greater of $100 or the amount you paid to access the Online Services (if any) during the 12 months before the event giving rise to the claim.

Dispute Resolution and Arbitration

31. Read This Section Carefully

This section requires arbitration of certain disputes and limits how you can seek relief.

A. Covered Disputes

“Dispute” means any claim arising out of or relating to the Online Services or these Terms.

This section does not apply to:

  • Claims that must be heard in small claims court (if within that court’s jurisdiction)

  • Claims seeking injunctive relief for alleged unlawful use of intellectual property

  • Claims that are not legally subject to arbitration

B. Class Action Waiver

You and WGH agree that disputes will be resolved only on an individual basis. You waive any right to bring or participate in a class, collective, consolidated, or representative action relating to a covered Dispute.

C. Agreement to Arbitrate; Waiver of Jury Trial

You and WGH waive the right to a jury trial for covered disputes. Covered disputes will be resolved by binding individual arbitration.

D. Notice and Informal Resolution

Before starting arbitration, the party bringing the Dispute will send written notice and allow 30 days to attempt informal resolution.

Your notice must include your name, address, contact details, a description of the Dispute, and the relief sought.

E. Arbitration Administrator and Rules

Arbitration will be administered under its applicable rules, unless the parties agree otherwise or the administrator is unavailable, in which case the parties will select a substitute.

Arbitration will take place in Warren County, Pennsylvania, unless the parties agree to a remote format or another permissible venue.

F. Time Limit to Bring Claims

Any claim relating to a Dispute must be filed within one (1) year after the claim arises, unless a longer period is required by applicable law.

G. Severability

If any portion of this Dispute Resolution section is found unenforceable, the remainder will remain in effect to the extent permitted by law.
